COUNCIL MINUTES
August 20, 2008
CALL TO ORDER:
Mayor called the meeting to order at 7:10 P.M.
PLEDGE OF ALLEGIANCE TO THE FLAG:
Mayor Spremulli led council in the Pledge of Allegiance to the flag.
ROLL CALL:
Bourisseau, Gillund, Hudson, Maurer, and Skipper - present. Sedlak – absent.
MOTION TO ACCEPT THE PRIOR WRITTEN MINUTES AND AUDIO RECORDING:
July 16, 2008 Meeting: Ms. Gillund corrected the minutes to read a horse crossing sign had been requested at the entrance to the Bentleyville Park, not Metropolitan Park. Mr. Maurer noted mis-spellings of several words. Motion to accept minutes as amended by Mr. Maurer, seconded by Mr. Hudson. Roll call: All present in favor.
MAYOR’S REPORT:
Mayor Spremulli recognized the contribution to the Village of the Eagle Scout Project of resident Colin Griffiths which provided new benches for the Bentleyville Park. Colin was also responsible for the Rain Garden project last year. Displays of the projects were available for the Council and audience to view.
Mayor Spremulli announced the resignation of Clerk-Treasurer Tomalin effective August 31, 2008. Mr Tomalin, a thirty year resident, will be moving to Mason, Ohio. Mayor Spremulli thanked Mr. Tomalin for his community service which dates back to 1988.
Mayor Spremulli announced that preliminary research has indicated the Union Cemetery located on Liberty Road appears to be owned by the Village and has been determined to be in a state of disrepair. If the Village ownership is in fact determined to be correct, the Mayor suggested it is the Village’s responsibility to properly maintain the cemetery and he will be asking the Parks and Beautification Committee to develop a plan for doing so.
FINANCE REPORT:
Mr. Tomalin gave the Treasurers report with account balances (see attached Cash Balances and Outstanding Obligations - June 2008).
LAW DIRECTOR’S REPORT:
No report.
BUILDING INSPECTOR REPORT:
Building Inspector’s report on file at Village Hall.
ENGINEER REPORT:
Engineer’s report on file at Village Hall.
CHIEF’S REPORT:
No Report
STREETS AND SAFETY REPORT:
No Report. Mr. Filarski commented that a public comment meeting to review the Liberty Road rebuild will be rescheduled to a later date since the notices for the original meeting were not mailed in time. The meeting has been rescheduled for September 8, and new notices will be mailed.
FINANCE, GRANTS & INSURANCE REPORT:
Mr. Maurer summarized his report and it is on file at Village Hall.
PLANNING AND ZONING REPORT:
Mr. Skipper the report of the June 25, 2008 Planning & Zoning meeting which is on file at Village Hall. Mr. Skipper noted that Ellerin had not posted a bond for their development. Mr. Filarski will follow up to make sure the over sight is corrected.
PARK, FACILITIES & BEAUTIFICATION REPORT:
Ms. Gillund summarized her report which is on file at Village Hall.
UTILITIES REPORT:
Mr. Skipper reviewed the minutes of the July Utility Committee which are on file at Village Hall.

2008-35 An Ordinance for the payment of bills in the month of August in the amount of $106,058.98 and declaring an emergency.
Motion to suspend the three reading rule by Mr. Maurer and seconded by Mr. Skipper. Motion to adopt by Mr. Maurer and seconded by Mr. Skipper. Motion Passed unanimously by those present in roll call vote.
2008-36 An Ordinance determining the video service provider fee to be paid by a video service provider offering video service in the Village pursuant to a state-issued video service authorization; authorizing the Mayor to give notice to the video service provider of the video service provider fee; and declaring an emergency.
Motion to suspend the three reading rule by Mr. Bourisseau and seconded by Mr. Maurer. Motion passed unanimously by those present in roll call vote. Motion to adopt by Mr. Maurer and seconded by Mr. Skipper. Motion Passed unanimously by those present in roll call vote.
2008-37 An Ordinance authorizing a change order with Carron Asphalt Paving, Inc. for the asphalt pavement maintenance program and declaring an emergency.
Motion to suspend the three reading rule by Mr. Skipper and seconded by Mr. Maurer. Motion Passed unanimously by those present in roll call vote. Motion to adopt by Mr. Maurer and seconded by Mr. Hudson. Motion Passed unanimously by those present in roll call vote.
2008-38 An Ordinance authorizing the Mayor to enter into a contract with QCI-CE to provide construction management services for the Liberty Road reconstruction project at an estimated cost of $23,500.00 and declaring an emergency.
Motion to suspend the three reading rule by Mr. Bourisseau and seconded by Mr. Maurer. Motion Passed unanimously by those present in roll call vote. Motion to adopt by Mr. Bourisseau and seconded by Mr. Maurer. Motion Passed unanimously by those present in roll call vote.
Motion to adopt the Village of Bentleyville Investment Policy Statement by Mr. Maurer and seconded by Mr. Hudson. Motion Passed unanimously by those present in roll call vote.
Motion to adopt Computer Back-Up Procedures by Mr. Maurer and seconded by Mr. Hudson. Motion Passed unanimously by those present in roll call vote.
PUBLIC COMMENTS FROM MEMBERS OF THE AUDIENCE:
None.
PRESENTATION BY CLEVELAND WATER DIVISION:
Mr. J. Christopher Nielson, Commissioner, Division of Water made a presentation regarding the proposed “no poaching water contract.” (See audio tape)
EXECUTIVE SESSION:
At 8:55 P.M. Mr. Hudson made a motion to move into Executive Session to discuss pending litigation. Motion seconded by Mr. Maurer. Motion passed by unanimous voice vote.
REGULAR SESSION:
At 9:06 P.M. Mr. Maurer made a motion to return to the regular session. Motion seconded by Mr. Skipper. Motion passed by unanimous voice vote.
ADJOURNMENT:
Motion to adjourn by Mr. Hudson and seconded by Mr. Skipper. Motion passed by unanimous voice vote. Meeting adjourned at 9:07 P.M.
