The meeting was called to order at 7:01 P.M.

Agenda

1. Continuing review of the proposed Cleveland Water Service Agreement

John had questions about potential legal issues, given the existence of multiple contracts for water from Cleveland, Chagrin Falls, and Geauga County. He was also concerned about the effect of transferring the asset value of the village water distribution system to Cleveland, and loss of that asset collateral for future financial issues.

He, however, felt both concerns would be thoroughly addressed by council members and the village administration through the three-reading process of a proposed ordinance to adopt the amended water service agreement.

I, on the other hand, expressed reservations about proceeding with adoption of the proposed amended agreement. Basically, for Bentleyville, the only difference between the proposed and current water service agreements concerns the distribution mains. Under the current agreement, the village would pay for cleaning, relining, and replacement of any problem mains. Under the proposed amended agreement, Cleveland would assume the cost of those activities, if, and when, the city chose to do so.
